General information

The protection of your personal data and the preservation of your privacy are very important to us. We handle your personal data sensitively and carefully and ensure a high level of data security.

We are committed to handling your personal data responsibly and therefore consider it a matter of course to comply with the Swiss Federal Act on Data Protection (FADP), the associated ordinances (FADP) and other applicable data protection regulations, in particular the European General Data Protection Regulation (GDPR). According to these provisions, every person has the right to protection of their privacy and protection against misuse of their personal data.

In cooperation with our hosting providers, we endeavour to protect the databases as best as possible against unauthorised access, loss, misuse or falsification. As the operator of this website, we adhere to the principle of ‘privacy by design’, which is why all data traffic is encrypted end-to-end. Personal data is treated as strictly confidential and is neither sold nor passed on to third parties.

We would like to point out that data transmission over the Internet can be compromised and may have security gaps depending on the security and configuration of the end devices and user behaviour (e.g. unencrypted email communication). It is not possible to completely protect data from unauthorised access by third parties.

2. Personal data, general term

Personal data is information that enables a natural person to be identified. This includes, in particular, your name, date of birth, address, telephone number, email address and the IP address of your device. Anonymous data is data that cannot be linked to any individual.

In this privacy policy, we describe how we collect and process personal data when you visit this website, use our applications or make use of our services. Processing refers to any handling of data, regardless of the means and procedures used, including reading, obtaining, disclosing, using, storing, transferring or modifying, as well as deleting data (Art. 5 lit. d and e DSG).

Where personal data (e.g. name, address or email address) is collected on our website, this is always done on a voluntary basis. This data will not be passed on to third parties without your express consent. We process personal data for the duration necessary for the respective purpose or purposes. In the case of longer-term storage obligations due to legal and other provisions to which we are subject, we restrict processing accordingly or store the data in encrypted form, if technically possible.

3. Visit of our website

When you visit our website, a notice regarding the use of cookies will be displayed. Cookies will only be set and scripts will only be executed after you have confirmed by clicking on the ‘Accept’ button (for more information on cookies, see section 6).

Creative Graphics allows you to block all types of cookies and scripts. This means that the website will not be displayed optimally and some functions will not be available.

Our website can generally be visited without registration. When you access our website, the following technically necessary data is temporarily stored in so-called server log files without this data being directly linked to your person:

  • IP address of the end device
  • Operating system (including language) of your end device
  • Browser used
  • Approximate location during retrieval
  • Name of your provider
  • Name and URL of the data accessed
  • Language and version of the browser software

This data is processed in order to provide you with the best possible user experience and to improve our offerings, which is in line with our legitimate interests. No personal user profile is created.

4. Personal data used for the provision of services

When you use the registration or order forms on our website or enquire about our services and other offers by email or telephone, we process your contact details and other personal data relevant to the contract. We process this personal data for the purposes of providing services and information about our services. This also applies to our social media presence, where we communicate with interested parties. The general terms and conditions (GTC) and terms of use as well as data protection declarations and other provisions of the individual operators of such platforms also apply in each case.

To respond to your enquiries, we require:

  • First name, surname
  • Email address
  • Membership number, if applicable

To conclude and process contracts relating to the use of paid services (e.g. membership), we require additional information as required by regulations:

  • Address
  • Postcode, town/city
  • Telephone number
  • etc.

We process your membership fee payments via the online payment service provider (PayPal), from which we only receive transaction data such as the transaction amount, payment date and a payment confirmation. 5. Forms

We process contact and transaction data in order to conclude and fulfil a contract with you or to communicate with you about our activities. Based on our legitimate overriding interest in informing you about new developments, offers and activities, we will provide you with relevant digital information if you are interested. You can opt out of receiving such information at any time.

We use various forms on our website which you can fill out and send to us. Depending on the form, we require different data from you, some of which is mandatory (marked with an *) and some of which is voluntary. The mandatory information is required in order to send you the desired information via your chosen communication channel. The voluntary provision of further data (without *) enables us to address you more personally.

6. Cookies

Based on our legitimate interests, we use cookies on our website to provide you with the best possible experience and to obtain information for improving our services. When you visit our website, you will be asked to reject or accept cookies.

Cookies are small text files that are stored on your device (computer, laptop, tablet, smartphone, etc.) with the help of your browser when you visit our website. Cookies do not cause any damage to your device, nor can they execute programmes or contain viruses.

Most of the cookies we set are so-called session cookies. These are automatically deleted when you close your browser or end the transaction with our website (e.g. filling out a form). Other cookies remain stored beyond the usage process and enable us to recognise your preferences the next time you visit (e.g. choice of language).

Most browsers are set to accept cookies. If you do not want this, you can configure your browser to notify you when cookies are set so that you can decide in each case whether you want to allow them or not. In addition, you can activate the automatic deletion of cookies, form data and temporary files when you close your browser and delete previously stored cookies at any time. 7. Google Analytics

This website uses Google Analytics, a web analytics service provided by Google Inc. (‘Google’). Google Analytics uses cookies to help analyse how you use our website. The information generated by this is usually transferred to a Google server in the USA and stored there. However, by activating IP anonymisation on this website, your IP address will be truncated by Google within member states of the European Union or in other signatory states to the Agreement on the European Economic Area.

Only in exceptional cases will the full IP address be transferred to a Google server in the USA and truncated there. Google will use this information to evaluate your use of the website, to compile reports on website activity for website operators and to provide other services related to website activity and internet usage. Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google's behalf. The IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data.

You can prevent cookies from being set by adjusting your browser settings accordingly. However, we would like to point out that in this case, not all functions of this website can be used to their full extent. By using this website, you consent to the processing of data collected by Google in the manner described above and for the purpose stated above.

8. Google reCAPTCHA

We use the reCAPTCHA function from Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA, or, if you are located in Switzerland or the European Economic Area, Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland (‘Google’) on our website.

The reCAPTCHA function is used to check whether the data entered on our website (e.g. in a form) is entered by a human or by a bot (automated script). To do this, the behaviour of the website visitor is analysed using various criteria. reCAPTCHA evaluates information such as IP address, length of stay, mouse movements, duration and type of entries in form fields, etc. The data collected during the analysis is forwarded to Google.

9. Hosting

Our trusted hosting provider is located in the heart of Zurich. Data security is a high priority for this long-standing contractual partner. All data is stored in a data centre in Switzerland.

10. Disclosure to third parties

We treat your personal data confidentially and only pass it on if you have consented to this, if we are legally obliged or entitled to do so, or if this is necessary to enforce our rights, in particular to enforce claims arising from the contractual relationship.

In addition, we will disclose your personal data to third parties to the extent that this is necessary or appropriate in the context of using the website or providing the services you have requested (including outside the website).

We may disclose your personal data to the following categories of recipients:

  • external service providers (e.g. hosting operators)
  • Authorities and courts

In doing so, we naturally comply with the legal provisions governing the disclosure of personal data to third parties. If we use processors to provide our services, we take appropriate legal precautions (processing agreements) and appropriate technical and organisational measures to ensure that your personal data is protected in accordance with the relevant legal provisions.

If the level of data protection in a country where the data is processed does not comply with the applicable data protection regulations, we contractually ensure that the protection of your personal data complies with that in Switzerland or the EU/EEA at all times, for example by incorporating the EU standard contractual clauses.

11. Storage period

We process and store your personal data only for the period necessary to achieve the purpose of storage or as required by laws or regulations to which we are subject. If the purpose of storage no longer applies or a prescribed retention period expires, your data will be routinely blocked or deleted in accordance with legal requirements.

12. Data security

We take technical and organisational security measures to protect your personal data against manipulation, loss, destruction or access by unauthorised persons and to ensure the protection of your rights and compliance with the applicable data protection regulations.

The measures taken are designed to ensure the confidentiality and integrity of your data and to guarantee the long-term availability and resilience of our systems and services when processing your data. They are also intended to ensure the rapid restoration of the availability of your data after a physical or technical incident.

Our security measures also include the encryption of your data. When your data is transmitted to us, it is encrypted using Transport Layer Security (TLS) / SSL. All information you enter online is transmitted via an end-to-end encrypted connection. This prevents unauthorised third parties from viewing this information.

Our email correspondence is transmitted in encrypted form to prevent unauthorised access or manipulation as far as possible. Our data processing and security measures are continuously improved in line with technological developments.

We also take our own internal data protection very seriously. Our employees and the service providers we commission are obliged to maintain confidentiality and comply with data protection regulations. Furthermore, they are only granted access to personal data to the extent necessary.

13. Your rights

Right to information
You have the right to request information from us about whether and which personal data we process about you.

Right to rectification
You have the right to request that your incorrect and, if necessary, incomplete personal data in our systems be corrected or supplemented.

Right to erasure
You have the right to request that your personal data be erased, e.g. if the data is no longer required for the purposes pursued. However, if we are obliged to retain your personal data due to legal or contractual retention obligations, we can only erase your personal data after the prescribed periods have expired.

Right to restriction of processing
You have the right to request that we restrict the processing of your personal data.

Right to data portability
You have the right to receive your personal data, which we process automatically on the basis of your consent or for the performance of a contract, in a structured, commonly used and machine-readable format, or to request the transfer of this data to a third party. If you request the direct transfer of the data to another controller, this will only be done if it is technically feasible.

Right to object
You have the right to object to the processing of your personal data at any time in accordance with the legal requirements. In particular, you have the right to object to the processing of your personal data for direct marketing purposes.

Withdrawal of consent
You have the right to withdraw your consent to the processing of your personal data at any time, with effect for the future.

Right to lodge a complaint
If you believe that the processing of your personal data violates data protection law or that your data protection rights have been violated in any other way, you can lodge a complaint with the supervisory authority responsible for you.

14. Changes

We expressly reserve the right to supplement or amend this privacy policy at any time. All amendments and supplements are at the sole discretion of Creative Graphics. The version published on our website applies in each case.
